DWI CASE
EXAMPLE: A citizen was arrested
for DWI. He did not take a breath test
after his arrest. After being released
on bail, he was later arrested again in a stolen car. He was locked up in the county jail for the
weekend, and brought to Court the following Monday. He went to his Court without a lawyer and
spoke to a police officer about a plea deal.
The officer gave the citizen a form and said that if the citizen pleaded
guilty to the DWI he could pay a fine, lose his license and get out of jail
that day. Believing the offered
penalties, as bad as they were, were the best he could do, the citizen pleaded
guilty to DWI. He lost his license for
one year, paid a hefty fine, was forced to attend a complete program, and
obtain an SR-22 proof of financial responsibility certificate and maintain the
SR-22 for three years.
The citizen was not aware
that he had other options, such as fighting the case and going to trial. He also did not know that his decision to
plead guilty could come back to bite him for years. He was later charged with a
an OUI in another state and his license was revoked for several
