BASIC FACTS: The defendant was found semi-conscious and badly injured in a truck that had collided with a telephone pole.  A large quantity of empty beer cans filled the truck’s cabin, and some beers had exploded on the impact of the crash to render a strong odor of beer throughout the scene.  The defendant admitted drinking several beers but denied driving.  The defendant told police that another man had driven who fled the scene.  Although the police found the other man a few miles away, the police blamed the defendant for the accident and charged him with several DWI related charges.  Because they didn’t believe the defendant they also charged him with lying to the police.  The defendant was transported to the local hospital where he submitted to a blood test that revealed a blood alcohol concentration of .15.  He could not do field sobriety tests due to the severity of his injuries.  The defendant was indicted in the Superior Court and faced 3 ½ to 7 years in the state prison on each of the felonies.  The Defendant hired Attorney Stevens and elected to fight the charges.

DEFENSE:     Attorney Stevens employed two experts in this case:  an alcohol analysis expert to analyze the blood results and an accident reconstruction expert to analyze the accident and crash.  The alcohol analyst reported the blood alcohol was lower than the reported value in the state’s reports.  The accident reconstruction expert rendered an opinion that the defendant could not have been the driver.  Both of the experts rendered favorable opinions and the state eventually dropped all charges.  After the charges were dropped Attorney Stevens successfully petitioned to have the records of the arrest and charges annulled from the defendant’s record!!!

RESULT:       ALL CHARGES DROPPED AND ANNULLED!!!
