DWI -FIRST OFFENSE CHARGE VACATED AFTER CONVICTION

DWI CASE EXAMPLE: THE DRIVER ARRESTED FOR DWI.  SHE PLEADED GUILTY AT HER ARRAIGNMENT, PAID HER FINE, LOST HER LICENSE AND COMPLETED A FIRST OFFENSE ALCOHOL PROGRAM.  SHE DID NOT KNOW THAT HER CONVICTION WOULD LATER HAUNT HER FOR YEARS TO COME…..

Please note-this is an example of the disposition of a recent New Hampshire DWI case. It is by no means a guaranty of any particular result in any other case.

BASIC FACTS:        In this case, the driver was arrested several years ago, and pleaded guilty to a charge of DWI, a first offense, at her arraignment.  The driver did not hire a DWI defense lawyer prior to her conviction.  She pleaded guilty, she paid her fine, surrendered her driver’s license, and enrolled in the relevant drunk driver school.  After completing the DWI school, she got her license back.

Little did she know at the time that this conviction would HAUNT this driver for years.  After she pleaded guilty and completed her sentence, the legislatures of both Massachusetts and New Hampshire changed their DWI “look-back periods”, and this driver was caught in the middle, suffering lengthy license suspensions and revocations in the years that followed her convictions.

She decided to consult with a DWI defense attorney to try and remedy this situation and get her right to drive back.  The driver hired Attorney Stevens to represent her in Court.  Attorney Stevens researched her case and determined that a number of constitutional defects existed that warranted filing a motion to vacate her prior conviction.

RESULT:       ATTORNEY STEVENS MOTION TO VACATE THIS DWI CONVICTION GRANTED!!! The conviction was taken off her record!!!!
